1. Definition of Terms
1.1. "Gamping Website": All the accessible items at the web address www.gamping.com.
1.2. "Service": The service offered by the Gamping Website.
1.3. "Gamping": The Gamping website editor, namely Joseph Léopold.
1.4. "User": Any person accessing the Gamping Website.
1.5. "Renter": Any person, owner of land for residential use, or co-owner or tenant with the agreement of all persons with possession of the premises, putting for rent a part or all parts of Land for Campers through the Gamping Website.
1.6. "Camper": Any person who reserves Land through the Gamping Website.
1.7. "Land": Land for residential use that the Renter offers Campers through the Gamping Website.
1.8. "Announcement": A page containing all the information concerning a Land with the goal of encouraging Campers to get in contact with the Renter.
2. Purpose, eligibility and acceptance
2.1. These general Terms of Service (hereinafter "TOS") set forth the conditions under which Users can use the Gamping Website.
2.2. Access to the Gamping Website is strictly subject to acceptance of and compliance with the preconditions of these present TOS, without reservation. All relations between Gamping and the User will therefore be governed by these present TOS.
2.3. Use of the Gamping Website signifies that you declare and confirm that you are 18 years of age or older, that you have provided correct information and will update it as needed, and that you have all the legal rights in your country to access and use the Gamping Website.
2.4. The contract finalized between the User and Gamping through this present document is open-ended and indeterminate.
2.5. In the event that any clause of these TOS is not admissible, or illegal or declared invalid, the clause is to be considered unwritten and will in no way affect the other clauses involved, which shall remain applicable without change.
3. Service offered by Gamping
3.1. The Service offered through the Gamping Website is free connection between Renter and Camper with the goal of entering into a leasing contract.
3.2. Gamping has a role in brokering and shall not take part in any way in the lease agreement between the Renter and the Camper. It is the sole responsibility of the Renter and the Camper to enforce the terms of the contract. Gamping will thus in no case be held responsible for non-compliance with the terms of this lease.
3.3. Any User may register provided they correctly fill all required fields of/in the registration form. In order to validate the authenticity of the e-mail address, an email containing a unique link will be sent. The User must then click on this link before connecting. Users are not allowed to register more than once. Each User account is strictly personal and cannot represent a corporate body, a family or a group of people.
3.4. Any User has the possibility of placing an online Announcement by correctly filling out the form used for this purpose. The creation of more than one Announcement is strictly prohibited. Validation of the form by the User will result in immediate publication of the online Announcement to the Gamping Website.
3.5. It is strictly forbidden to put in one's Announcement:
- Any hyperlink pointing to a domain other than the Gamping Website.
- Any content allowing contact with the Renter without going through the form provided for this purpose, specifically including the address of the Land, a phone number or an email address.
- All content that does not appeal directly to the rental of Land.
- Any content that may infringe or violate the rights of a third party or the intellectual property code.
- Any content vulgar, racist, pornographic, abusive or foul in nature.
3.6. Gamping reserves the right to send out emails of legal or technical nature to Users.
3.8. Gamping reserves the right at the end of the beginning promotional period to change and to bill the linking service hitherto offered to both parties.
3.9. The Use of the Gamping Website is exclusively reserved for the conclusion of lease agreements of Land for the purpose of camping. Any other use that may be possible through the Gamping Website is strictly prohibited.
3.10. Gamping connects the Renter and the Camper by allowing both parties to communicate by email. Communication and validation of booking and payment is therefore outside of the Gamping Website. Gamping cannot guarantee smooth proceedings of the lease and assumes no responsibility. Only the two parties, the Renter and the Camper, shall be responsible.
4. Access to the site
4.1. Gamping agrees to provide an online platform that is as reliable and safe as possible. However, in a constant effort to improve the Gamping Website or due to exceptional circumstances, it is possible that Gamping will decide, voluntarily or involuntarily, to make the Gamping site inaccessible. The User affirms that he or she is aware of and accepts that the Gamping Website may experience malfunctions or be temporarily inaccessible. Gamping not be held liable for the total or partial interruption of the Service.
5. General behavior of Users
5.1. Users agree to be courteous and respectful in all dealings whether online or offline.
5.2. The Camper who owns the account from which the exchange began with the Renter (hereinafter called "Principal Camper") is fully responsible for other people accompanying him or her as well as the smooth lease proceedings. We will call the "Group of Campers," the Principal Camper, and the persons accompanying him or her officially under the lease of the land.
5.3. The Renter promises not to rent the Land for more than 3 months either continuous or not, and not to allow simultaneous access to more than 6 vehicles and/or 20 people. The Renter certifies that the activity on the Gamping Website will remain an adjunct and occasional activity.
5.4. Each User declares to have checked with a competent authority the legal provisions that apply to lease the Land and certifies respect of the laws that apply in his country. Indeed, each User has the duty to inform himself of the legality of his actions. Gamping shall not be held responsible for non-compliance with legislation.
5.5. The Camper and the Renter must comply immediately with any request from the authorities. If unable to complete his rental term in response to a request from the authorities, the Renter shall return the overpayment to the Camper before that the latter leaves the premises.
5.6. The Principle Camper ensures compliance by the Group of Campers rules set by the Renter. The Group of Campers shall in no way interfere with the activities of the Renter and/or residents.
5.7. The Principal Camper has no right to allow a person not initially included in the lease to enter the Land unless the Renter gives his express consent.
5.8. The Principal Camper agrees that the Group of Campers will not cause any damages of any nature whatsoever: in particular, to a property, to an animal or to vegetation.
5.9. The Camper agrees not to bring an animal unless the Renter expressly gives his consent. In this case, the Renter cannot be held responsible for the loss or injury of an animal. In respect for the Renter and the residents, the Principal Camper will ensure that droppings caused by the animal or animals are collected. Unless authorized by the Renter, each animal must remain under control and must not move freely on the Land.
5.10. The Renter has the right to impose a Curfew. In this case, the Principle Camper shall ensure its proper respect by the Group of Campers.
5.11. For moving a vehicle onto the Land, the speed of this vehicle shall be reduced to a maximum of 5km/h.
5.12. For safety, outdoor habitations should be sufficiently spaced to facilitate an emergency evacuation.
5.13. Fires and grills are prohibited without express authorization by the Renter. The Principal Camper agrees to comply with all safety standards in force in the country, in particular to ensure that the land is cleared away from the house, and a fire extinguisher or a full water bottle is near.
5.14. The Principal Camper agrees that the Group of Campers will not pollute the environment in any way: visually, chemically, olfactorily or acoustically. In particular, he will ensure good sewage of waste water and chemical toilets. If in doubt, he shall seek advice from a competent authority.
5.15. The Principal Camper agrees to return the Land to the state in which it was found and to evacuate the premises at the time scheduled with the Renter, having taken care of making the payment beforehand. The Principal Camper agrees to return all goods provided by the Renter in their original state.
5.16. In case of cancellation, a minimum of 2 weeks notice is required.
5.17. Any Renter who offers free or paid food agrees to comply with the standards set forth by law regarding the sale of food.
5.18. The Renter agrees to comply with all safety standards in force particularly regarding electrical installations, sanitary facilities, water points, and pools. Gamping declines all responsibility in the case of an accident.
6. User Responsibilities
6.1. Because Gamping cannot verify all the Announcements nor control all information provided by Users, Gamping cannot be held responsible for the accuracy of the Announcements nor the information specified on the profiles of registered Users. The Renter declares full responsibility for the content published and disclaims any prosecution against Gamping (including attorney fees). The Renter certifies ownership of all rights to the information, images, and documents provided to Gamping.
6.2. The User declares that it is in his power to yield all rights of content provided to Gamping (notably copyrights and archiving rights).
6.3. Each User must ensure, by himself, respect of the legislation applicable in his residential area.
6.4. Each User is warned that Gamping cannot be held responsible for data retention. It is for this reason that each User shall take precautions to save for himself the content that he provides to Gamping.
6.5. As Gamping does not offer insurance, it is the responsibility of each Renter to check with their insurance company regarding coverage of the entire property before even placing an Announcement online.
7. Gamping's Responsibilities
7.1. Gamping disclaims any liability for any interruption of service, site malfunction, or loss content.
7.2. Gamping disclaims any liability in cases of any breach of these TOS.
7.3. Gamping is not responsible for any damage that may be caused directly or indirectly to the Camper or to the Renter. In particular, this includes the loss of property, theft, injury to a person or animal, and damages of all kinds .
8. Protection of personal data
8.1. In the case of identity theft, the User should notify Gamping as soon as possible by sending an email to email@example.com
8.2. It is strictly forbidden to use the data contained on the Gamping Website or obtained through the Gamping Website to conduct any commercial solicitation or any form of advertising or commercial activity for profit or not.
9. Intellectual Property
9.1. The entire contents of this platform are subject to copyright and belong to Gamping. It is strictly prohibited to copy all or part of any text, image, source code or any other content on the Gamping Website without obtaining specific permission from Gamping.
9.2. Gamping reserves the right to use the content provided by Users for commercial or promotional purposes in whatever format.
9.3. This site has been made subject to a CNIL declaration under number 1658218.
9.4. Gamping keeps personal data in accordance with the Data Protection Act of January 6, 1978. Under these circumstances, the User may exercise his or her right to correction or deletion of personal data by making a request by email to firstname.lastname@example.org or by writing to 3 rue du 78940 La Queue Lez Yvelines.
10. Website update and TOS
10.1. These present TOS were updated March 9, 2013. Gamping reserves the right to change them without notice. Under these circumstances, the User is invited to consult the TOS on a regular basis.
10.2. Gamping reserves the right to change the Gamping Website without notice so long as the changes do not affect these TOS.
11. Applicable law and relevant jurisdiction
11.1. If any part of these TOS prove to be unlawful or void, that portion shall be declared unwritten and will in no way affect the remaining paragraphs of these TOS.
11.2. These TOS are subject to French law.
